Social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the personal complementary budget for the month in which the death occurred, and, as the case may be, social benefits due and unpaid until death, shall be paid to the surviving spouse, children, parents or, in their absence, to other heirs, under the conditions of common law, upon their request. The amounts above may be requested, at the territorial agency for payments and social inspection, by the heir, within the general prescription term, based on the document attesting heirship, and, in case there are several heirs, a declaration on their own responsibility that the other heirs do not request these amounts.
