Free movement of workers is one of the fundamental rights guaranteed by the Treaty establishing the European Union. A worker is ‘posted’ when he or she is employed in an EU Member State but is temporarily sent by his or her employer to work in another Member State. To ensure that the rights and working conditions of a posted worker are protected throughout the EU, European Community legislation has established a core set of binding rules on the terms and conditions of employment, which also apply to a posted worker working in another Member State.
