The sale of agricultural land located outside built-up areas, without respecting the right of preemption or without obtaining approvals, is prohibited and sanctioned with absolute nullity.

Publicizing the sale offer of agricultural land located outside built-up areas - the person who wishes to sell must register, at the Town Hall in whose administrative area the land is located, a request to display the sale offer for the respective area, to notify the preemptors. Within 5 working days from the registration date of the request, the Town Hall will display the sale offer, for 45 working days, at its headquarters. Also, within 10 days, the Town Hall is obliged to notify the holders of the right of preemption regarding the registration of the sale offer. In case of non-exercise of the right of preemption, potential buyers may submit to the Town Hall a file containing the supporting documents proving that the conditions are met, within 30 days from the expiration of the aforementioned 45 working days period. In case of non-exercise of the right of preemption and if none of the above potential buyers, within the legal term, meets the conditions to purchase the agricultural land located outside built-up areas, its alienation by sale can be done to any individual or legal entity, according to the law.
