Registering a patent application at OSIM is not mandatory and is done for a fee, the fee regime being established by Government Ordinance no. 41/1998, regarding fees in the field of industrial property protection and their usage regime, with subsequent amendments and completions. The standard form “Patent Application” must be completed in 3 copies accompanied by the relevant documents which consist of: summary, description, drawings (if applicable), claims. These can be submitted on-line, by mail or at the OSIM headquarters. Examination of a patent application is carried out in accordance with the provisions of Law 64/1991 concerning invention patents, with subsequent amendments and completions, as well as the Implementation Regulations, provided that the legal fees are paid. Public registers can be consulted here, and OSIM decisions are subject to appeals.
