The registration of a utility model application at OSIM is not mandatory and is done for a fee, the fee regime being established by Government Ordinance no. 41/1998, regarding the fees in the field of industrial property protection and the regime for their use, with subsequent amendments and completions.
The standard “Utility model application” form must be filled out in 3 copies, accompanied by the relevant documents consisting of: abstract, description, drawings (if applicable), claims.
These can be submitted by mail or at the OSIM headquarters. The examination of a utility model application is done in accordance with the provisions of Law 350/2007 regarding utility models, as well as the implementing regulations. OSIM decisions are subject to appeals:
