The application for registration in the trade register and the operating authorization of functioning shall be submitted to the trade register of the tribunal in the county where the applicant establishes its professional office. The Certificate of Registration in the Trade Register of the sole traders, sole partnerships and family partnerships is based on the motivated resolution of the Director of the Trade Register Office by the Law Court. The deadline for issuing the certificate of registration is 3 working days of the calculated from the date of request registration or, where applicable, the date of complete the application with the required documents. Fees and tariffs must be paid at the counter, by postal order or payment order. For payment order, the accounts (correspond to the National Trade Register Office in the territory of which has its registered office at county level) to which shall be paid the amounts needed, can be found at the address: http://www.onrc.ro/index.php/ro/inmatriculari/operatiuni-prealabile/servicii-de-asistenta?id=43. For applications that are submitted online through the portal of services NTRO http://portal.onrc.ro, the payment of fees and tariffs shall be made on-line by the portal http://portal.onrc.ro. According to art. 112 para. (1) and (2) of Law no. 265/2022 regarding the trade register and for the amendment and completion of other normative acts impacting the registration in the trade register, “(1) Against the registrar's decision pronounced according to art. 108 or, as the case may be, according to art. 110, the applicant may file an appeal within 10 calendar days from the communication of the decision, if the applicant requested communication through the methods provided in art. 111 para. (1) letter b) and c). In these cases, the applicant may also file an appeal from the date of publication of the decision in the Bulletin, if this occurs before the communication.”

(2) In the case provided in art. 111 para. (1) letter a), if the decision is not picked up from the counter within the documentation release period, the applicant may file an appeal within 10 days from the date of publication of the decision in the Bulletin.”

The appeal is submitted, in the case of authorized natural persons, individual enterprises and family enterprises, to the court in whose territorial area the professional headquarters of the applicant is located.
