Methodology regarding the automatic recognition, at the “1 December 1918” University of Alba Iulia, of teaching positions obtained in accredited higher education institutions abroad*

The procedure for automatic recognition of university teaching positions obtained in accredited educational institutions abroad applies to:

a) Romanian citizens,

b) citizens of member states of the European Union, the European Economic Area, within the Swiss Confederation

c) citizens from third countries.

The procedure applies to positions obtained in:

a) accredited university institutions from member states of the European Union, the European Economic Area, and from the Swiss Confederation;

b) prestigious universities from other states listed in the List of Prestigious Universities from Other Countries, approved by order of the Minister of National Education and updated periodically;

c) other accredited university institutions abroad other than those mentioned, only on the basis of an international mutual recognition agreement concluded at intergovernmental or inter-university level;

The applicant submits a request accompanied by a recognition dossier for the teaching position. The evaluation committee, appointed by the rector’s decision, analyses the dossier, draws up an evaluation report and issues a decision regarding the resolution of the application, which is communicated to the applicant within 30 days from registration. By exception, this period may be extended if the committee requests additional supporting documents from the applicant or if the documents require additional verification from other competent institutions. The additionally requested documents will be submitted by the applicant within a maximum of 15 working days from the date of the request.

The recognition dossier may be submitted: - in person, at the General Secretariat of UAB, Alba Iulia, str. Gabriel Bethlen no. 5;

- online, at: chava@uab.ro

- via the Electronic Single Control Point (PCUe)

- via postal/courier services to the address: "1 Decembrie 1918" University of Alba Iulia, Romania, str. Gabriel Bethlen no. 5, postal code 510009.

The decision of the evaluation committee or the appeals committee, as the case may be, as well as the rector’s decision shall be issued to the applicant:

- at the university headquarters, during university working hours;

- by post, to the declared address;

- electronically to the address indicated in the recognition request - via the Electronic Single Contact Point (PCUe).

The recognition by UAB of teaching positions obtained in accredited university institutions abroad is valid and produces legal effects only at UAB level. Recognition of the teaching position by CNRED is valid and produces legal effects throughout Romania.

The recognition of teaching positions obtained in accredited university institutions abroad does not automatically confer the right to occupy a teaching position within UAB. Holding a teaching position within UAB is obtained by following the internal procedures and regulations in force at the time of application. Holding a teaching position in the Romanian higher education system is done according to the legal norms in force.

Methodology for recognizing the status of PhD supervisor at "1 December 1918" University of Alba Iulia obtained in accredited higher education institutions abroad*

The status of doctoral supervisor or habilitation obtained in accredited higher education institutions in member states of the European Union, the European Economic Area, the Swiss Confederation, and in prestigious universities in other states listed in the List of prestigious universities from other states (https://www.cnred.edu.ro/en/updated-list-prestigious-foreign-universities) approved by order of the Minister of National Education and periodically updated, is automatically recognized by higher education institutions and, respectively, by institutions organizing doctoral university studies in Romania;

The provisions of this methodology apply to Romanian citizens, citizens of member states of the European Union, the European Economic Area, the Swiss Confederation, and citizens of third countries;


THE FILE, PROCEDURE AND ISSUANCE OF THE RECOGNITION DECISION

The file includes the following documents:

a) the application for recognition of the status of doctoral supervisor or habilitation, drafted according to the model in Annex 1 and signed by the applicant;

b) identity document (copy with handwritten mention by the applicant regarding conformity with the original) and proof of name change compared to the name on the study documents - copy and legalized translation (if applicable);

c) doctoral diploma, if the study document is obtained in Romania or at one of the accredited higher education institutions mentioned in point I.1 (in copy and legalized translation), or the recognition certificate issued by CNRED for the doctoral diploma, if the study document is obtained at other accredited higher education institutions abroad (certificate in certified copy, accompanied by a copy of the doctoral diploma);

d) diploma/certificate attesting the status of doctoral supervisor or habilitation, issued by the institutions mentioned in point I.1, clearly stating the doctoral field in which the applicant obtained the supervision status or habilitation (copy and legalized translation);

e) curriculum vitae;

f) list of works and scientific contributions, assumed by the applicant through signature;

g) receipt of payment of the processing fee for the recognition file of the status of doctoral supervisor or habilitation;

h) for states that are signatories of the Hague Apostille Convention, the study documents subject to recognition must be apostilled by the competent authorities of the issuing countries; for states that are not signatories of the Hague Apostille Convention, the study documents must be super-legalized or accompanied by the Certificate of authenticity issued by the competent authorities of the country of origin.

(3) The documents provided in paragraph (2) are submitted in a simple copy accompanied by the original (for verification of conformity with the original) or in a certified copy.

(4) The file for the recognition of the status of doctoral supervisor or habilitation obtained abroad may be submitted:

- in person, at the General Secretariat of UAB, Alba Iulia, str. Gabriel Bethlen no. 5;

- online, at doctorat@uab.ro;

- via the Single Electronic Contact Point (PCUe);

- by postal/courier services to the address: "1 Decembrie 1918" University of Alba Iulia, Romania, str. Gabriel Bethlen no. 5, postal code 510009.

In the case of submission via PCUe, the document from letter d) will be issued by the institution where the applicant obtained the status of doctoral supervisor or habilitation with a qualified electronic signature.

.Procedure regarding the recognition of the status of doctoral supervisor or habilitation

The commission that evaluates the recognition file and pronounces the solution regarding the recognition request, hereinafter referred to as the Evaluation Commission, is composed of 3 members: the Director of the Doctoral School in the field for which recognition is requested (or, as the case may be, a member of the CSUD) and two members of the respective Doctoral School. The structure of the Evaluation Commission also includes a substitute member from the Doctoral School in the field for which the recognition of the status of doctoral supervisor is requested and a technical secretary. The Evaluation Commission is appointed by Decision of the Director of CSUD (Annex 2).

For the evaluation of the file for recognition of the status of doctoral supervisor or habilitation, the Commission proceeds as follows:

a) verifies the status of the higher education institution that issued the documents subject to recognition and the doctoral study program in which the applicant requests recognition of the status of doctoral supervisor or habilitation. If there are doubts about the authenticity and legality of the issuance of the documents submitted in the file, they will be sent to CNRED in electronic format for verification, the CNRED's finding being mandatory;

b) rejects the file if the issuing institution of the document attesting the status of doctoral supervisor or habilitation does not fall within the requirements mentioned at I(1) and (2) of this methodology, or if the field of doctoral university studies in which the status of doctoral supervisor or habilitation was obtained does not correspond to the doctoral field in which the respective Doctoral School operates;

c) the Evaluation Commission will prepare a Report containing the solution regarding the recognition request (Annex 3) within 30 days from the submission of the file (except when documents require additional verification at the competent institutions). The decision of the Evaluation Commission is adopted by the majority vote of the members and is forwarded to the university management.

d) The decision issued by UAB may be contested within 10 working days of its communication to the applicant. The appeal is submitted to the Technical Secretariat of the Evaluation Commission and is resolved by the Appeal Resolution Commission. This is composed of 3 persons designated by the Director of CSUD of UAB, members of the doctoral schools within IOSUD-UAB, other than those who constituted the Evaluation Commission. The Appeal Resolution Commission's report is drawn up within 5 days from the date the commission is appointed and is final.

e) The recognition decision or the decision of non-recognition of the status of doctoral supervisor/habilitation is issued by the Rector of "1 Decembrie 1918" University of Alba Iulia, in accordance with legal norms. The decision is communicated to the applicant: at the university headquarters, during business hours, by mail to the declared address, electronically to the address indicated in the recognition application submitted in the file, through the Single Electronic Contact Point (PCUe), with a qualified electronic signature.

FINAL PROVISIONS

(1) The recognition by UAB of the status of doctoral supervisor obtained in accredited foreign higher education institutions is valid and produces legal effects only at the level of this higher education institution.

(2) The recognition of the status of doctoral supervisor or habilitation by IOSUD-UAB does not automatically confer the right to supervise doctorates within IOSUD-UAB. The status of doctoral supervisor within a Doctoral School operating within UAB is obtained by following the internal procedures and regulations in force at the time of application.

(3) This Own Methodology of UAB regarding the automatic recognition of the status of doctoral supervisor obtained in accredited foreign higher education institutions at the institutional level was approved by the Senate of "1 Decembrie 1918" University of Alba Iulia in the meeting of 24.11.2021, the date on which it enters into force.

The methodology regarding the recognition at "1 December 1918" University of Alba Iulia of the doctoral diploma and the title of doctor in sciences or in a professional field, obtained abroad*

II.2.Procedure regarding the recognition of the doctoral diploma and the title of doctor in sciences or in a professional field, obtained abroad.

(1) The recognition file is evaluated by the Council of Doctoral University Studies (CSUD) of IOSUD-UAB.

(2) The period for CSUD to process the files is 30 working days from the date of registration of the complete file.

(3) If the CSUD finds that the file does not contain the documents provided for in II.1, para. (1), it notifies the applicant. The file must be completed within no more than 45 days from the date of receipt of the notification, otherwise, the CSUD closes the file, and the procedure will be resumed based on the submission of a new file.

(4) Based on the decision issued by the CSUD, the UAB Rector issues the Decision on recognition or non-recognition of the doctoral diploma. The decision is communicated to the applicant by post, to the correspondence address indicated in the recognition request, via the Single Electronic Contact Point (PCUe) with qualified electronic signature.

(5) The commission’s evaluation decision may be appealed within 10 working days from its communication to the applicant. The appeal is lodged following the same procedure as in II.1(3) and is resolved by the Appeals Resolution Commission. This is composed of 3 persons appointed by the Director of the CSUD of UAB, members of the doctoral schools from IOSUD-UAB, other than those who constituted the Evaluation Commission. The report of the Appeals Resolution Commission is drawn up within 5 days from the appointment of the commission.

f) After the expiration of the appeal period, the Decision and the evaluation commission’s report or, as the case may be, the Report and the decision of the Appeals Resolution Commission, are forwarded to the Rector who issues the Decision on recognition/non-recognition of the status of doctoral supervisor/habilitation.

g) The Rector's decision is communicated to the applicant within 5 days from its issuance:

- at the university headquarters, during the university working hours;

- by post, to the declared address;

- electronically to the address indicated in the recognition request filed in the file;

- via the Single Electronic Contact Point (PCUe), with qualified electronic signature.

h) Against the Rector’s decision of non-recognition, the applicant may appeal to the competent court within 30 days from being informed.


Remedy method:

The appeal is submitted to the “1 Decembrie 1918” University of Alba Iulia,

- at the university headquarters, during the university working hours;

- by post, to the declared address;

- electronically to the address indicated in the recognition request filed in the file;

- via the Single Electronic Contact Point (PCUe), with qualified electronic signature.

subsequently, the final decision of the University can be challenged in the courts of law
